Steven Avery denied new trial

US judge delivers bad news for the man in Making a Murderer case.

Steven Avery, who featured in the hit Netflix documentary series Making a Murderer, has been denied a new trial by a judge in Wisconsin.

Sheboygan County Judge Angela Sutkiewicz this week ruled that Avery had not met the standard to get a new trial.

Both Avery and his nephew, Brendan Dassey, were convicted in 2007 in connection with the murder of photographer Teresa Halbach in 2005.

In early June, Avery’s lawyer filed a more than 1,000-page motion seeking a new trial, claiming his conviction had been based on planted evidence and false testimony.

“We are filing an amended petition because we have additional test results and witness affidavits. The scientific testing is not completed,” lawyer Kathleen Zellner said. “We remain optimistic that Mr. Avery’s conviction will be vacated.”

She vowed to keep fighting for a new trial and could still take his case to the Wisconsin Court of Appeals.

In August, a US appeals court agreed to reconsider the decision of a federal judge who overturned Dassey’s conviction, ruling it was based on a coerced confession he gave as a 16-year-old with a learning disability.

The officials involved in the case have denied any misconduct.
