Judy Davis defamation win boosted by extra $10k

Following her defamation win against the Daily Telegraph, Judy Davis was awarded $150,000 plus costs -including an extra $10k in interest.

Actress Judy Davis has been given an increase in the damages in a defamation win against the Daily Telegraph in July.

The Supreme Court ruled in July that Davis was entitled to $140,000, but Justice McClellan reserved his judgement to consider the amount of interest to which she should be entitled.

But Justice Peter McClellan ordered Nationwide News to pay the two-time Oscar nominee $150,736 plus her legal costs.

The Daily Telegraph, the Courier-Mail, the Sunday Mail and the Perth Sunday Times implied she had behaved in an “unreasonable and selfish” way in opposing a development in Birchgrove, Sydney.

“In my opinion it should have been apparent to the defendant at the time of the publications that Ms Davis had been defamed,” he said.

“At the very least a reasonable offer at that time would have included an apology.

“It should also have been obvious to the defendant that not only had the published imputations damaged Ms Davis’s reputation but they had also caused her significant anguish.”
