‘Elly-May Clampett’ sues over Barbie lookalike

78 year old Donna Douglas, who played Elly-May Clampett on The Beverly Hillbillies, has settled a lawsuit with Mattel toys over her likeness being used in an “Elly-May” Barbie doll.
Douglas, who played the hayseed character from 1962 to 1971, sued the toy company in May as well as the consumer products division of CBS Corp. seeking a minimum of $75,000 in damages.
Her complaint said Mattel was “engaging in the unauthorised use” of her name, likeness and image for the doll, which comes complete with a slingshot.
CBS Consumer Products had argued that it had exclusive rights to use the Elly-May character, and did not need Douglas’ permission.
The financial terms were not revealed.

That would do it!
Mattel’s mistake was that they used a photo of Donna Douglas on the packaging.
I would have thought CBS was right too, wouldn’t they own the intellectual property?
