Newspaper to appeal ruling in Geoffrey Rush case

Daily Tele stands by its article on actor Geoffrey Rush and plans to appeal a recent ruling.

The Daily Telegraph will appeal against a ruling which struck out its defence against allegations published around actor Geoffrey Rush.

Last week a judge ruled that when the case goes to trial, use of the truth and qualified privilege defence could not be used.

But today Tom Blackburn SC told the court the newspaper “took care, great care that what was published was true”.

“We don’t believe there were any errors of fact,” he said.

 

Rush’s legal team called that a delaying tactic and said the case should proceed as planned in August so Rush can “vindicate his reputation”.

The Federal Court also heard Rush intends to take the stand.

Last week a judge ruled against Nationwide News’ subpoena to the Sydney Theatre Company, describing it as a ‘fishing expedition’ in the hope of finding something in support of its plea.

The case will return to court on April 9.
