Nine Network and WIN head back to the NSW Supreme Court today for a decision on their stoush over Live streaming.
WIN claims Nine is denying it advertising revenue by the 9Now Live streaming service being accessible in WIN markets.
The landmark ruling is being watched closely by industry, including Seven West Media, Southern Cross Media and Prime Television, for a decision on whether Live Streaming equals Broadcasting.
Fairfax Media reports Justice Hammerschlag will hand down his ruling this afternoon.
Nine, which launched 9Now in late January, has argued it would be difficult to shut down its service in WIN markets without shutting down the entire service.

Well we are in a VIC Broadcast area (but on Border of NSW) I cannot get VIC streaming and are forced to watch NSW stream…
Don’t use 9s catch up service anymore due to the account requirement. When I turn on the tv to watch free to air I don’t need an account so why is it a requirement for a free to air catch up site that includes a live stream?
A bit curious about the outcome of this. Can you regulate the live stream on the internet the same way as broadcast television? Is it possible to geoblock city vs country?
How can you regulate broadcast TV? where I live in Sydney I can get all of the Illawarra services!!
Bit confused by your comment. Broadcast TV is already regulated. Just because you can get illawarra services in sydney doesn’t mean others in sydney can. You probably just live in an area where there is some overlap with the signal.

Before aggregation we were able to get both WIN and NBN in Sydney because their coverage area was larger due to transmitting in the FM Radio spectrum. We had a much larger choice of programs and the ads were mostly irrelevant to us but often produced a smile.
It will be interesting to see how the Judge avoids regulating the Internet and I expect some form of compensatory payment being introduced. I have been known to be totally wrong!
