Judge rejects suppression request in McLachlan defamation case

Judge denies a request to suppress 3 more names in the case between Craig McLachlan & ABC / Fairfax.

A judge has denied an application to suppress the identities of three women in the defamation case instigated by Craig McLachlan.

On Friday barrister Lyndelle Barnett, representing ABC / Fairfax / Christie Whelan-Browne, said three new people had come forward including a second person who had made a complaint to police. But the latter also wanted their identity kept confidential.

McLachlan’s barrister, Stuart Littlemore QC, opposed the application and said it would hamper his ability to mount a defence.

Justice Lucy McCallum denied the application due to insufficient evidence as to their relevance to the case. She said it was ambiguous in the affidavit whether the person intended to stand as a witness, noting there were no details provided on any criminal investigation.

Barrister Lyndelle Barnett indicated the defence may make another application later.
