Court extends Mel B injunction

No decision on Mel B being able to join Nine until another week.

2013-03-25_1418The Supreme Court in Sydney has extended an injunction application by the Seven Network over Melanie Brown joining the Nine Network to judge Australia’s Got Talent.

Justice Hammerschlag has also granted a temporary confidentiality order over the amount of salary paid by Seven and Nine for her services after lawyers for both sides agreed it should remain confidential.

But they disagreed on Brown’s right to enter into a new contract.

Brown’s barrister, Thomas Blackburn said, “Channel Seven, on all the evidence, have no plans to use (Brown).

“They merely want to … stop her appearing on another TV station.

“They’re not suffering any harm. They have no plans to use her.”

Peter Brereton SC, representing Nine, said there was “a serious prejudice that occurs every day the injunction is in place”.

“Every day is hurting,” he said.

Brown previously appeared on both The X Factor and Dancing with the Stars for Seven but told the network visa problems for her family limited her ability to continue.

Nine has cast her in Australia’s Got Talent alongside Kyle Sandilands, Timomatic and Dawn French.

A final hearing is set for Wednesday April 3rd.

Brown’s husband and manager, Stephen Belafonte, will be called to give evidence at the hearing.

We must not forget channel 9 in all this, they are equally to blame surely Mel B had a copy of her contract and if so why didn’t 9 look at it and see the conditions, and when it was said there was a verbal agreement to let he break a contract, that sort of thing does not happen in these cases, everything has to be in black and white, I think 9 just want to say that is a feather in our cap we have pinched this person from this channel and this person from that channel they are like little children these days, what has happened to channel 9, they really are pathetic, think a certain person would turn in his grave to see this.

In my opinion Channel 7 gave Mel B a new kick start in life and this is the way she repays them, and to say that they had nothing to offer her is rubbish, they waited until the last minute before they gave the role to Danni, who I am sure will be much more preferred by everyone than Mel B and her greediness.

    They mustn’t have much money left for judges so they got a work experience kid in.

    Vile Kyle is sad enough but I have never heard of him (? her? it?) and I watch a lot of bad television.

    Seven did plan to use her but she said she couldn’t stay because of visa and personal issues then she jumped ship. I love Mel B but she is in the wrong here. I hope Seven wins the case because it would be unfair if she was allowed to jump ship. Its dishonest. I must say whoever the lawyer is though is dumb.

  6. @Jel, it’s fair because she decided to sign the contract, no one forced her. She agreed get paid millions just to not appear on 9.

    9 should be happy that this will drag on for a few more weeks. If they don’t get Mel, atleast they are getting this free publicity. But Mel B is not coming across well. Seems very greedy.

  7. She should not be allowed to break a contract to get more money elsewhere. That’s greedy and would set a precedent for future contracts which would become worthless and easily broken.

  8. How is it fair if Seven don’t intend to use her at all? Why have a contract with her? However if she used the visa excuse as a way to go to Nine and get more money, then she is probably screwed. That’s just plain dishonest. And I agree with Mr J; her lawyer doesn’t seem to have a very strong argument.

  9. I’m a big fan of Mel’s judging skills! But the fact she lied to Seven is not acceptable in my opinion. The argument that seven has no plans to use her is just plain stupid the only reason they arn’t using her is because she left so that had to find replacements! Dumb lawyer! I’d say she has no chance! Maybe we could start using all the talent with have in Australia for Australian TV no more imports!

  10. Always liked Mel B, but I think what she has done is wrong, if she used unsustainable excuses to move to nine (probably offered more money) then I hope that channel 7 win the case.
