Legal battle looms for What About Tonight

X Factor boyband act may be sued by former management.

More trouble is brewing behind the scenes of hit series The X Factor, with reports that a legal battle is looming between teen boyband What About Tonight and their former management, David Caplice and Alfred Touhey.

Caplice has an extensive career in the music industry, having managed Human Nature for years plus Shannon Noll, Guy Sebastian and Jessica Mauboy.

WAT has previously claimed, ”We all met through YouTube. Mitchell’s older brother Clinton found us and we skyped each other, we literally met four days before the audition.”

But sources tell the Sun-Herald Caplice and Touhey created the act, casting them from huge auditions held around the country, developed it, named it, and and paid for them to travel to Sydney for intensive dance rehearsal.

Earlier this year Caplice went on TEN’s Breakfast to announce he was scouting for talent for a boy band.

”And once the boys hit the top 12 [on the program] they reneged on the deal they had with them,” the source said.

The source said the group had signed a short-term initial letter of intent as a binding contract with Caplice and Touhey but later pulled out. There is speculation the act may be sued.

Seven said it was aware of an issue but ”FremantleMedia Australia and the Seven Network have no involvement”.

What About Tonight is mentored by Ronan Keating.

  1. IMO What About Tonight shouldn’t be in the top 12 anyway. I have been saying this since the start but they will probably make the finale because of the teenage girls votes.

As for this issue its hard to delve into but who knows. It could of happened but must say there is a lot of bad press about this show right now but it seems to happen with all the popular shows lately.

  2. So there manages dumped them and now that they may be about to become the next big boy band they want back in??? sounds a little like that story of the american band suing a british boy band over the name of the group… If you choose not to sign someone and they end up making it big it is your bad luck. deal with it.

  3. Too many boybands this year is a turnoff…I have watched every season of The X Factor Australia that has aired so far, even the 2005 season on Ten, but I’m tempted to switch off atm…all this controversy is hurting the show and there’s really not that many good acts this year compared to last

Last year I found Reece, Declan, Three Wishes and Audio Vixen quite compelling…this year my favourites were Adil, Josh and Bella, and Adil and Josh have already gotten the boot…
